INFORMATION PURSUANT TO ART. 13 OF REGULATION (EU) 2016/679
Dear Customer,
Emmeti Store Srl, with registered office in Via Torino, 168 – Collegno, as “Data Controller”, hereby informs you of the methods of processing of your data by the Company in relation to the activities defined by the contract and related to the request for information through our contacts (email, telephone, etc.), in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and related implementing legislation (hereinafter, jointly, the “Regulation”).
1. The data concerning you are:
a) collected during telephone/computer contact with our company
b) provided pursuant to a contract entered into with our Company
2. Your data may be processed for the following purposes:
c) sending commercial or promotional communications from us, also relating to services other than those you have already purchased from us (in the event of your express acceptance of this processing);
The legal basis for the processing of personal data is the execution of a contract for the purposes referred to in letter b), and your consent for the purposes referred to in letters a), c).
3. Providing data is optional. However, any refusal to provide data for the purposes referred to in point 2 letter c), will not entail any consequences, except for the impossibility of being informed about any marketing and promotional-advertising initiatives by the Company, as well as receiving commercial communications of interest to you.
4. In relation to the purposes referred to in point 2 above, the processing of data by the Company will take place using IT and telematic tools with logic strictly related to the purposes themselves and, in any case, in a way that guarantees their security and always in full compliance with the legislation in force regarding the protection of personal data.
5. In order to execute the contract, your data will be processed by the Company's employees who have access to them by virtue of the functions performed (for example Administration, Commercial, etc.).
The Company may communicate your personal data to external parties, with reference only to the data strictly necessary to ensure the provision of services.
These entities will have access to the personal data necessary to perform their functions (and will not be able to use them for different purposes), will be required to process the data in accordance with applicable law, will be data controllers appointed by the Company and will be included in an updated list, available from the Company.
Except as stated above, your personal data will not be disclosed to other third parties or otherwise disseminated. Your personal data will be stored on servers available to the Companies located in the European Union, and will not be transferred in any way to countries located outside the European Union.
6. Any data collected and processed with your consent for the purposes indicated in letter c), will be retained until the interested party revokes consent to receive commercial communications from Emmeti Store Srl or requests the deletion of his/her data, except for the exceptional need to retain the data to defend the rights of Emmeti Store Srl in relation to disputes in progress at the time of the request, or upon indication of the public authorities.
7. Pursuant to articles 15 to 22 of the Regulation, you have the right to: a) obtain the cessation of processing in cases where your personal data are processed for direct marketing purposes, including in relation to services identical to those already provided by our Company (so-called right to object); b) obtain information in relation to the purposes for which the personal data are processed, the period of processing and the subjects to whom the data are communicated (so-called right of access); c) obtain the rectification or integration of inaccurate personal data concerning you (so-called right to rectification); d) obtain the erasure of personal data concerning you in the following cases (i) the data are no longer necessary for the purposes for which they were collected; you have withdrawn your consent to the processing of data if they are processed on the basis of your consent; you have objected to the processing of personal data concerning you if they are processed for our legitimate interest; or the processing of your personal data is not compliant with the law. However, we point out that the retention of personal data by Emmeti Isolanti Srl is lawful if it is necessary to allow you to fulfill a legal obligation or to ascertain, exercise or defend a right in court (so-called right to erasure); e) obtain that the personal data concerning you are only stored without any other use being made of them in the following cases (i) you contest the accuracy of the personal data, for the period necessary to allow us to verify the accuracy of such personal data; the processing is unlawful but you still oppose the erasure of personal data by us; the personal data are necessary for the ascertainment, exercise or defense of a right in court; (iv) you have opposed the processing and are awaiting verification regarding the possible prevalence of our legitimate reasons for processing over yours (so-called right to restriction); f) receive in a commonly used, machine-readable and interoperable format the personal data concerning you, if they are processed pursuant to a contract or on the basis of your consent (so-called right to portability).
Finally, we remind you that you have the right to contact the Guarantor for the Protection of Personal Data (Piazza di Monte Citorio n. 121, 00186 Rome), in order to assert your rights in relation to the processing of personal data.
You may revoke, at any time, the consent given for the processing of your personal data for the purposes referred to in point 2 letter c) without prejudice to the lawfulness of the processing based on consent prior to revocation. You may revoke your consent by sending a communication to the email address support@emmetistore.it
